Important information for current or former credit account holders of the Army and Air Force Exchange Service who had delinquent retail debt.
What Is This About?
A settlement has been proposed in a class action lawsuit alleging that the Army and Air Force Exchange Service (Exchange) overcharged interest on delinquent retail, or deferred payment plan (DPP), debt. The proposed settlement provides that the Exchange will pay approximately $2.77 million to settle the interest overcharge, and related claims, of the Class members. Who Is Included?
The class includes approximately 63,000 service members, retirees, veterans, and their dependents who had delinquent retail debts with the Exchange. Most class members paid their delinquent retail debt in full between 2003 and 2010 and did not cash a refund check issued by the Exchange in 2010 or 2012 for overpaid interest. What Can You Get?
Class members will be sent settlement proceeds for the interest overcharge, less court-approved deductions for attorney fees and costs. If your interest overcharge amount is less than $3, the settlement proceeds will be donated to charity due to the costs of administration.
What If I Already Received A DPP Interest Refund Check from the Exchange?
You may cash your refund check from the Exchange before May 19, 2013 and you will be excluded from the Class; after that date, the Exchange will no longer honor previously-issued DPP interest refund checks presented by Class members. The settlement payment check will replace the prior interest refund check issued to you by the Exchange and will be for a lesser amount.
What Are Your Options?
If you do nothing, you will be mailed a settlement check (if your interest overcharge amount is $3 or more) at the most recent mailing address identified by the Class Administrator; your claim for overcharged interest against the Exchange will be extinguished even if you do not receive or cash the settlement check. If you do not want to be legally bound by the settlement, you must act by May 19, 2013. Class members who do not receive a notice in the mail about this proposed settlement should call the Class Administrator below and provide your current mailing address.
This notice has been authorized by the United States District Court to publicize the pending settlement and your legal options.

We now have two cases pending against the Army and Air Force Exchange Service (AAFES) which runs stores for military personnel and carry their debt collection practices. Approximately 100,000 veterans have received refunds as a result of these actions, two of which are still pending.
